This agreement
These terms are a contract between you and Kuickr Technologies Inc. (Kuickr, we, us, our), a company incorporated in Canada with its head office in Halifax, Nova Scotia. They govern your use of the Kuickr apps, our website, and our delivery service.
By creating an account or placing an order you accept these terms. If you do not accept them, do not use Kuickr.
Our Privacy Policy explains how we handle your personal information and forms part of this agreement.
Who can use Kuickr
You must be the age of majority in your province or territory, able to enter a binding contract, and located in an area we deliver to. One account per person. You may not use Kuickr if we have previously closed your account.
Your account
Keep your account details accurate and your sign-in credentials to yourself. You are responsible for what happens on your account, unless it results from our failure to keep our systems secure. Tell us at cs.support@kuickr.ca straight away if you think someone else has access to it.
You can close your account at any time from the app. Closing it does not cancel an order already in progress, and does not erase records we are required to keep — see the Privacy Policy.
Orders and availability
Listings in the app are an invitation to order, not an offer. Your order is an offer to buy, and the contract forms when we confirm the order in the app.
Stock moves quickly. If an item is unavailable after you order, we will substitute it according to the preference you set, or remove it and charge you only for what we delivered. We may cancel an order, in whole or in part, if an item turns out to be unavailable, if the price or description was obviously wrong, if we cannot safely reach the address, or if we suspect fraud. If we cancel, we refund what you paid for the cancelled part.
Product images are illustrative. Weights, sizes, and packaging can vary, and fresh items sold by weight may be billed to the actual weight picked.
Prices, fees, and tips
The total shown before you confirm is what you pay. It is made up of:
- Item prices, which may differ from the in-store price at the same retailer;
- A delivery fee, shown before you confirm and which can vary with distance, demand, and weather;
- A service fee, where one applies;
- Applicable taxes; and
- Any tip you choose to add. Tips are optional, go to the courier, and can be adjusted for a period after delivery.
Prices and fees can change at any time, but never after you have confirmed an order — except where the order includes items priced by weight, in which case the final weight is billed.
Payment
We take payment through a third-party payment processor when you confirm your order, or place an authorisation hold and take payment when the order is delivered. You authorise us to charge the payment method you selected for the full amount, including any post-delivery tip adjustment you make.
If a payment fails or is reversed, we may suspend your account until it is settled.
Delivery
Delivery times are estimates, not guarantees. Times shown in the app and in our marketing, including any average delivery time we publish, describe typical performance. Traffic, weather, building access, and demand all affect a given order, and we do not promise that a specific order will arrive within a specific time.
You are responsible for:
- giving an accurate address and any access instructions;
- being reachable on the phone number on your account during delivery; and
- arranging for someone to receive the order, or authorising us to leave it.
If you authorise an unattended drop-off, risk passes to you when the order is left at the address. If nobody is available and no drop-off was authorised, we will try to reach you; if we cannot, we may return the order and charge for perishable items.
Age-restricted items
Where we deliver items that are age-restricted by law, the courier will ask for government-issued photo identification on delivery. We will refuse delivery, with no refund for the restricted items, if identification is not produced, if it does not match the account holder, or if the person receiving the order appears intoxicated.
Cancellations, refunds, and problems
You can cancel free of charge until we begin picking your order. After that we may charge for items already picked, and for the delivery fee if a courier is already on the way.
If something is missing, damaged, spoiled, or plainly wrong, tell us within 48 hours through the app or at cs.support@kuickr.ca. We may ask for a photo. Where the problem is ours, we will refund or replace the affected items. Refunds go back to the original payment method and typically take five to ten business days to appear.
Nothing here limits the rights you have under applicable consumer protection law.
Promotions and credits
Promotional offers, referral credits, and free-delivery offers have their own terms, shown with the offer. Unless the offer says otherwise, they are for one account, cannot be exchanged for cash, and expire. We may withdraw an offer, or reverse a credit, where we reasonably believe it has been obtained through duplicate accounts, automated means, or other abuse.
How you may use Kuickr
Do not:
- use Kuickr for anything unlawful, or to buy items for resale;
- abuse, threaten, harass, or discriminate against a courier, shopper, store employee, or member of our support team;
- place fraudulent orders, make dishonest refund claims, or run duplicate accounts to exploit promotions;
- scrape, copy, or reverse-engineer the service, interfere with it, or probe it for vulnerabilities without our written permission; or
- use the service in a way that puts anyone at risk of harm.
We may suspend or close an account that breaks these rules, and we will report unlawful conduct to the authorities.
Couriers and partner stores
Deliveries may be carried out by independent contractors and orders may be picked at partner stores. Those partners are responsible for the goods they supply and the standards they are required to meet by law. We remain your point of contact for problems with an order placed through Kuickr.
Our intellectual property
The Kuickr name, the K mark, our apps, our website, and their content belong to us or our licensors. We grant you a personal, revocable, non-transferable licence to use the app to order from us. Everything else is reserved.
If you send us feedback or suggestions, we may use them freely and without obligation to you.
Disclaimers
We provide the service with reasonable skill and care, but we do not promise that it will be uninterrupted, error-free, or available in your area at any given moment. Except as set out in these terms and as required by law, the service is provided as is.
Check the packaging of anything you order for allergens, ingredients, and best-before dates before you use it. Information shown in the app comes from manufacturers and can be out of date.
Limitation of liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law — including your rights under consumer protection legislation.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, or loss of opportunity, and our total liability relating to any order is limited to the amount you paid for that order.
Suspension and termination
You can stop using Kuickr and close your account at any time. We can suspend or close your account if you break these terms, if we are required to by law, or if we stop operating in your area. Where it is reasonable to do so, we will tell you why and give you a chance to put it right.
Changes to these terms
We publish changes as a new version with a new effective date, and the previous version stays available at its own permanent link. For significant changes we will give you notice in the app or by email before they take effect. Continuing to use Kuickr after that means you accept the new version. Orders already placed are governed by the version in force when you placed them.
Governing law
These terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada that apply there. Disputes go to the courts of Nova Scotia, except where the law of your province or territory gives you the right to bring a claim where you live.
